Application of the Terms
These Terms and Conditions (hereinafter "the Terms") govern the relationship between Pulse Studio BV, a company registered in Belgium (Company Number: BE1015 083 422, Bondgenotenlaan 121, 3000 Leuven), and its clients (hereinafter "the Client").
The Terms apply to all services, products, offers, orders, contracts, and invoices provided by Pulse Studio BV to the Client, unless otherwise agreed in writing. Pulse Studio BV is only bound by these Terms and any other applicable terms of use. Any other terms, including prior communications or negotiations, are excluded.
By purchasing a product or service from Pulse Studio BV, the Client confirms that they have read and fully accept these Terms without reservation. Pulse Studio BV reserves the right to modify these Terms at any time, without prior notice, in order to comply with legal obligations or improve its services. The Client is advised to review the Terms at check-out each time before entering into a new agreement with Pulse Studio BV.

House rules
The Client acknowledges that all classes at Pulse Studio are conducted in English. By booking and attending a class, the Client affirms their understanding and comfort with the use of English during instruction.

The Client understands that Pulse Studio has a strict cancellation policy to ensure fairness to all clients and instructors. The Client agrees to review and adhere to the cancellation guidelines available on the booking platform prior to reserving a class. As of the Failure to cancel within the specified time frame will result in the loss of used class credits.

Pulse Studio reserves the right to cancel any class that has fewer than 4 participants. In the event of such a cancellation, the Client will be notified in advance and will be given the opportunity to reschedule the class or receive a full refund for the canceled session.

The Client agrees that sticky socks are mandatory for all reformer pilates classes for hygiene and safety reasons. The use of sticky socks ensures a clean and safe environment while promoting proper execution of exercises. Clients who do not wear sticky socks will not be permitted to participate in the class

Intellectual Property
The Client acknowledges that Pulse Studio BV, or an affiliated entity of Pulse Studio BV, remains the exclusive owner of all intellectual property rights relating to the website, app, and services offered (including, but not limited to, classes, workshops, and other activities organized by Pulse Studio BV). Pulse Studio BV is also the sole owner of the name, brand, and logo used to offer products and services both online and offline.
Liability Disclaimer and Limitation of Liability
Pulse Studio BV makes every effort to provide its services according to the highest professional standards, but it cannot be held liable for any loss, damage, or theft of personal belongings, either inside or outside the studio. The company is not liable for any material, immaterial, or bodily injury caused by third parties, nor for consequential damage, such as loss of profit, revenue, or business opportunities.
The Client acknowledges and agrees that participation in classes, workshops, and other activities organized by Pulse Studio BV occurs at their own risk. Pulse Studio BV and its employees take all reasonable measures to ensure the safety of participants, but they cannot be held liable for any bodily injury or damage sustained by the Client during a class or activity, regardless of the cause of the incident.

The Client agrees that they will not take legal action against Pulse Studio BV or its employees in the event of bodily injury or damage during a class, workshop, or other activity, unless the injury or damage is directly caused by willful misconduct or gross negligence by Pulse Studio BV or its employees.

In other cases, such as an accident due to the Client's own negligence or participation in a physical activity for which the Client is insufficiently prepared or trained, Pulse Studio BV cannot be held responsible for any resulting damage. This also applies to any damage caused by the use of the studio’s facilities or equipment.
The Client further declares that they do not have any medical condition, disability, or other physical or mental condition that would hinder their participation in classes or use of the facilities. If the Client has concerns about their physical or mental health, it is their responsibility to consult a physician before participating in any activities.
Personal Data
The Client agrees to provide accurate and complete personal information at registration and throughout the duration of the agreement.
Pulse Studio BV collects, processes, and stores the Client's personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian privacy laws. More information about how Pulse Studio BV processes personal data can be found in the Privacy Policy of Pulse Studio. Clients may contact Pulse Studio BV with any questions or requests regarding the processing of their personal data at pulsestudio@outlook.be.
Force Majeure
Neither Pulse Studio BV nor the Client shall be held liable for any delay or failure to perform obligations under these Terms due to force majeure. Force majeure is defined as an event beyond the reasonable control of the affected party that prevents the normal execution of these Terms. This includes, but is not limited to, natural disasters, strikes, epidemics, and technical failures.
The affected party must notify the other party and make reasonable efforts to mitigate the impact of the force majeure event. If the force majeure lasts for more than ninety (90) days, either party may terminate the Agreement without compensation.

Assignment and Subcontracting
Pulse Studio BV is entitled to engage subcontractors (including instructors or other third parties) to perform services under this Agreement without the prior consent of the Client.
Membership subscriptions and credits are personal and non-transferable. They may not be shared or used by anyone other than the registered member. Violation of this provision will result in immediate termination of the membership without refund.

Miscellaneous
The failure or delay of Pulse Studio BV in enforcing any provision of these Terms shall not be considered a waiver of that provision or any other rights under these Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the validity of the remaining provisions will not be affected. Pulse Studio BV and the Client will make reasonable efforts to replace the invalid provision with a valid provision that closely reflects the original intent.

Applicable Law and Jurisdiction
These Terms and Conditions are governed by Belgian law. In the event of a dispute, both parties agree to first attempt to resolve the matter amicably before taking legal action.
The courts of Leuven, Belgium, shall have exclusive jurisdiction over any disputes arising from these Terms, unless mandatory legal provisions require otherwise.
If the Client resides outside Belgium, Pulse Studio BV may, at its discretion, choose to bring the case before the competent courts of the Client’s place of residence.
